In any case, you affirm that you are over the age of 13, as DESIWEST Services are not intended for children under 13. If you are under 13 years of age, then please do not use DESIWEST Services. There are lots of other great services available to you on the Internet. Talk to your parents about what sites are appropriate for you.

Entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by DESIWEST, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Any use of the content not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws.

Advertising

Advertiser is solely responsible for any legal liability arising out of or relating to (1) the Advertisement, and/or (2) any material to which users can link through the Advertisement. Advertiser represents and warrants that the Advertisement and Link comply with DESIWEST advertising standards; and that it holds the necessary rights to permit the use of the Advertisement and Link by the purpose of this Agreement; and that the use, reproduction, distribution, or transmission of the Advertisement will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any anti discrimination law or regulation, or any other right of any person or entity. Advertiser agrees to indemnify DESIWEST and to hold harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by DESIWEST, arising out of or related to Advertiser’s breach of any of the foregoing representations and warranties. Advertiser agrees to request that DESIWEST be listed as an additional insured on any policy issued to Advertiser pursuant to which there could be coverage for any of the forms of legal liability described in this paragraph.

LIMITATION ON DAMAGES: IN NO EVENT WILL DESIWEST BE LIABLE TO SPONSOR FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT DESIWEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

DESIWEST will remove any ads that are reported to us as being scams. If one of the advertisements on our site is not providing what they are advertising to do so, please email us the details and we will remove the ad.

You agree to indemnify, defend and hold DESIWEST harmless from and against any third party claim, loss, liability, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s) (DESIWEST), arising out of Your use of our advertising options, Your Web site, and/or Your breach of any term of this Agreement.

Before purchasing ads you must agree to our Advertising Terms of Use that: We are not responsible for any of your site’s downtime. You rent a banner for a period of time, and if your site is offline during that time, you take the responsibility. We will not extend your advertising due to these circumstances.

You are NOT allowed to place ads to fraudulent sites, investment scams, or Ponzi Schemes. We reserve the right to decline any future publishing of the ads if people complain to us (no refunds given). We will remove any ads that direct to any site that is proven to be a scam. We are in no way affiliated with any of our advertisers and are not responsible for their actions. We do not guarantee the activity that your advertisements will receive, such as the number of clicks you will get. We reserve the right to determine the size, placement, and positioning of your advertisements. You agree to pay for your advertisements in accordance with our Subscription and Recurring Payments Terms of Use.

Payments

DESIWEST may make available to you various payment processing methods to facilitate the purchase of products and/or services. You must abide by any relevant terms and conditions or other legal agreement, whether with DESIWEST or a third party, that governs your use of a given payment processing method. You agree to pay for any products and/or services that you order and that DESIWEST may charge your credit card or other form of payment that you indicate for any products and/or services ordered, along with any additional amounts (including any taxes). By purchasing any products and/or services, you represent and warrant that any credit card or payment information you supply is true and complete. You agree that you are solely responsible for all fees associated with purchases you make associated with DESIWEST.

Subscriptions & Recurring Payments

All payments are due immediately on their monthly or annual renewal date. To cancel your subscription or recurring payment, you must contact us at least five (5) business days prior to your monthly or annual renewal date. Failure to give this adequate notice may result in payment being processed automatically and renewal of the next subscription period. All payments are FINAL and NO refunds will be issued once payment has been processed.

Refund Policy

You may cancel your order for our products and/or services at no cost by providing a notice before the agreed upon time. You must cancel your service request via telephone or email. However, once any of the work is performed or services are rendered by DESIWEST or any of its supplied contractors to perform or produce any part of the product and/or service, or you did not give adequate notice time for a cancellation or request a change, you are liable for full payment of the entire order amount. You are liable for all work performed and services rendered.

If there is a conflict or disagreement with the product and/or service and it is reported within a reasonable time period (Approximately 7 days), we will do everything possible to rectify the problem and ensure your fulfillment. This is handled on a case-by-case basis depending on situation and may include re-performing and/or reproducing parts of the product and/or service, and possibly providing a discount or future discount on your account. Reshoots and/or discounts must be first approved. Please allow 10 business days for any approved refunds.
